These Terms of Service (“Terms”) govern guided trips, courses, instruction, and related services offered by IN A DAY LLC, a New Hampshire limited liability company doing business as Core Mountain Guides (“Core Mountain Guides,” “Core,” “we,” “us,” or “our”).
In New York, IN A DAY LLC operates under the fictitious name Core Mountain Guides LLC. Core Mountain Guides LLC is not a separate legal entity from IN A DAY LLC.
By booking or participating in a Core Mountain Guides trip, course, or other program (“Program”), you agree to these Terms.
1. Booking and Payment
Reservations are generally made through Origin, our third-party booking platform.
Unless otherwise expressly stated, 100% of the Program price is due at the time of booking. A reservation is not confirmed until the booking process is completed and payment is received.
Participants are responsible for providing complete and accurate information during booking and trip preparation, including information concerning experience, abilities, fitness, equipment, and other matters reasonably requested by Core Mountain Guides.
Use of Origin and any integrated payment-processing services may also be subject to the terms and privacy policies of those third-party providers.
2. Guest Cancellations and Rescheduling
All cancellation requests must be made in writing and sent to paul@coremountainguides.com.
A cancellation is effective when the written request is received by Core Mountain Guides.
Refund eligibility is as follows:
More than 30 days before Program launch: Refund of Program charges less a $50 administrative fee.
15 through 30 days before Program launch: Refund of 50% of all Program charges.
Fewer than 15 days before Program launch: No refund. Program charges are forfeited.
No-show: Failure to be present and ready to participate at the scheduled Program launch will be treated as a no-show, and the Program fee will be forfeited.
A request to move a reservation to another date is treated as a cancellation and is subject to the same policy.
We strongly recommend purchasing travel insurance that provides appropriate coverage for cancellation, illness, trip interruption, travel delays, and other circumstances that may prevent participation.
3. Weather, Conditions, and Changes to the Program
Climbing, skiing, mountaineering, avalanche education, and other mountain activities take place in dynamic environments.
Core Mountain Guides reserves the right to change the location, route, objective, terrain, itinerary, schedule, start time, or other aspects of a Program because of weather, route or snow conditions, avalanche hazard, access restrictions, participant ability, group considerations, or other circumstances.
A change in itinerary, location, route, terrain, or objective is not a cancellation and does not entitle a participant to a refund.
Payment is for professional guiding or instructional services, not for the successful completion of a particular summit, climb, ski descent, route, amount of vertical gain, or other objective. Specific objectives are never guaranteed.
Guides and instructors retain professional discretion concerning terrain selection, routes, turnaround times, avalanche exposure, group management, weather, conditions, and other operational decisions.
4. Cancellation by Core Mountain Guides
Core Mountain Guides may cancel a Program because of inclement weather, route or snow conditions, avalanche hazard, closures or access restrictions, insufficient enrollment, guide availability, or other circumstances that make the Program impractical or inappropriate.
If Core Mountain Guides cancels the entire Program before it begins, participants will receive a full refund of amounts paid to Core Mountain Guides for that Program.
This refund applies only to amounts paid directly to Core Mountain Guides. Core Mountain Guides is not responsible for airfare, lodging, rental vehicles, transportation, meals, equipment, or other expenses paid to third parties.
5. Participant Responsibilities and Conduct
Participants must honestly and accurately represent their experience, fitness, physical abilities, and other information requested by Core Mountain Guides.
Participants are expected to:
Arrive at the designated meeting location on time;
Bring required equipment;
Follow reasonable instructions from guides and instructors;
Conduct themselves in a manner that does not create unnecessary risk or disruption; and
Notify the guide or instructor of relevant changes in condition, ability, or circumstances that may affect participation.
Core Mountain Guides may modify a participant's Program, restrict participation, or terminate a participant's involvement if, in the guide's professional judgment, the participant:
Materially misrepresented their experience, fitness, ability, or other relevant information;
Is unable to safely or appropriately participate in the planned activity;
Is impaired by alcohol, recreational drugs, or another substance affecting judgment or physical ability;
Refuses reasonable guide or instructor instructions;
Engages in unsafe, threatening, abusive, or seriously disruptive conduct; or
Arrives without equipment reasonably required for participation.
A Program is not considered cancelled by Core Mountain Guides merely because an objective is changed or an individual participant's involvement is restricted or terminated after the Program has begun.
Unless Core Mountain Guides determines otherwise, such circumstances do not entitle the participant to a refund.
6. Late Arrivals
Participants are responsible for arriving at the designated meeting location at the scheduled time.
A late arrival may require Core Mountain Guides to shorten, modify, or otherwise adjust the Program. If a late arrival prevents reasonable participation, the participant may be treated as a no-show.
No refund is owed for Program time or objectives lost because of a participant's late arrival.
7. Assumption of Risk and Required Documents
Rock climbing, mountaineering, skiing, ski mountaineering, backcountry travel, avalanche terrain, hiking, and related activities involve inherent and other risks, including risks that cannot be completely eliminated through professional guiding, instruction, equipment, planning, or risk-management practices.
All participants must complete Core Mountain Guides' required waiver, release, and assumption-of-risk documentation through Origin before the Program begins.
Participants are also required to complete a separate medical or participant-information document as directed by Core Mountain Guides.
These Terms do not replace, supersede, or modify any separately executed waiver, release, assumption-of-risk agreement, medical document, or other participant agreement. Those documents remain independently applicable according to their terms and applicable law.
A participant who fails or refuses to complete required documents may not participate and remains subject to the applicable cancellation policy.
8. Minors
Core Mountain Guides does not maintain a universal minimum age for participation. Suitability depends on the particular Program, objective, conditions, experience, and abilities of the participant.
Participants under 18 must have required documents completed or authorized by a parent or legal guardian to the extent required by applicable law.
For group Programs, including avalanche education courses, participants under 18 must be accompanied by a parent or legal guardian unless Core Mountain Guides expressly agrees otherwise in writing.
9. Equipment
Core Mountain Guides may provide loaner equipment for certain Programs.
Participants must use provided equipment as instructed and return it at the conclusion of the Program.
Participants are responsible for the reasonable repair or replacement cost of equipment that is lost, not returned, or damaged beyond ordinary wear and tear.
Core Mountain Guides may determine that equipment supplied by a participant is inappropriate or inadequate for a Program and may require different equipment before participation.
10. Transportation
Unless expressly stated otherwise, participants are responsible for their own transportation to and from meeting locations, trailheads, climbing areas, ski areas, lodging, and other Program locations.
Core Mountain Guides is not responsible for transportation costs, delays, missed Program time, or other consequences resulting from a participant's transportation arrangements.
11. Photography and Media
Permissions concerning photographs, video, or other media captured during a Core Mountain Guides Program are governed by the participant waiver or other documentation completed for that Program.
12. Third-Party Services, Land Access, and Facilities
Programs may involve public lands, private property, climbing areas, ski facilities, transportation providers, lodging providers, equipment providers, educational organizations, land managers, or other third parties.
Those entities may impose their own rules, fees, permits, waivers, closures, reservation requirements, or restrictions.
Core Mountain Guides is not responsible for the actions, policies, availability, closures, facilities, or services of independent third parties.
13. Website Information
Information provided on the Core Mountain Guides website is intended for general informational purposes.
Mountain conditions, weather, avalanche forecasts, access, regulations, equipment recommendations, prices, schedules, Program details, and other information may change.
Website content should not be relied upon as a real-time assessment of weather, route conditions, snow conditions, avalanche hazard, access, or other mountain hazards.
14. Intellectual Property
Unless otherwise indicated, original website text, photographs, graphics, logos, branding, Program descriptions, and other materials published by Core Mountain Guides are owned by or licensed to IN A DAY LLC.
These materials may not be reproduced, republished, distributed, sold, or otherwise used commercially without permission, except as permitted by applicable law.
15. Privacy
Personal information collected through our website, booking process, and Programs is handled in accordance with the Core Mountain Guides Privacy Policy and, where applicable, the privacy practices of Origin and other third-party service providers.
16. Governing Law and Venue
To the fullest extent permitted by applicable law, these Terms and disputes arising from them or from services provided by Core Mountain Guides are governed by the laws of the State of New Hampshire, without regard to conflict-of-law principles.
To the fullest extent permitted by applicable law, any legal action arising out of these Terms or Core Mountain Guides' services will be brought in a court of competent jurisdiction located in Carroll County, New Hampshire.
Programs conducted in New York, Europe, or other jurisdictions may also be subject to mandatory laws, consumer protections, or jurisdictional requirements applicable where the services are provided. Nothing in these Terms is intended to waive a right or obligation that cannot lawfully be waived by agreement.
17. Severability
If any provision of these Terms is determined to be invalid or unenforceable, that provision will be enforced to the maximum extent permitted by law, and the remaining provisions will remain in effect.
18. Changes to These Terms
Core Mountain Guides may update these Terms from time to time.
The current version will be posted on the website with its most recent revision date. Unless otherwise required by law, updated Terms apply prospectively to bookings made after the revised Terms become effective.
